THE ROLE OF THE AFTER-DISASTER INSURANCE EXPERT IN THE FRAMEWORK OF AMICABLE AND CONTRADICTORY EXPERTISE

An insurance appraisal is carried out by virtue of an agreement between the parties to a contract.
The insured's expertise is essential for fairness: the interests of the insurance company or company and those of the affected customer only rarely converge.


The victim who does not call on an expert completely independent of the company or insurance company finds himself in the same situation as a litigant who accepts that the lawyer of the opposing party ensures his defense at the same time!!! This is obviously to the detriment of its interests and fair justice.


The insured's adjuster's primary mission is to advise his client on safeguard measures, to explain his rights and responsibilities, in order to protect his interests within a contractual and legal framework.
He establishes and justifies, with the claimant, the list of building losses, contents, and operating losses.

He values them and formalizes, on behalf of his principal, from the elements communicated, his own knowledge and estimates, after a complete analysis of the insurance contract, the causes and circumstances of the claim, a statement of Building / Furniture losses / Materials / Merchandise / Embellishments / Fittings / Operating Losses, statement which is sent by him to the expert appointed by the company or insurance company. It also quantifies in this claim the amounts of the indemnities to which the victim is entitled under the additional guarantees, such as loss of use, compliance, design office or decorator fees, expert fees, etc.

The damages, as the provisions of the insurance contract provide for, will then be jointly assessed between the insured's adjuster and that of the insurance company.
The victim is associated with these operations.


It is from the contradictory estimate of the damage that the company or insurance company, in application of the clauses and conditions of the subscribed contract, will propose an indemnity.


It is up to the adjuster to ensure that this offer and the proposed compensation conditions are the most favorable and he also intervenes in the context of any claims against third parties and their insurance companies.
